Member Terms of Service

These Member Terms of Service ("Member Terms") govern your use of Perchworth as a member — meaning a person who reads the site, uses the calculator, saves scenarios, joins the community, contacts vendors, or otherwise interacts with the product as a consumer of senior-care information. They do not cover vendor accounts; those are governed by the Vendor Terms of Service.

By creating an account you agree to these Member Terms. If you do not agree, do not create an account.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract in your jurisdiction. Perchworth is intended for adults — often caregivers, family members, or seniors themselves — researching options for aging-in-place or residential senior living. We do not knowingly collect information from anyone under 13, in line with the Children's Online Privacy Protection Act (COPPA).

If you are using Perchworth on behalf of a parent or other relative, you represent that you have the authority to do so. We do not require power-of-attorney documentation, but you are responsible for the consequences of any choice you make in their name.

2. Your account

You sign in using a magic link sent to your email address. You are responsible for keeping access to that inbox under your control. Anyone who can read your email can sign in to your Perchworth account. If you lose control of your email address, contact us so we can disable the account.

One account per person. You may not impersonate another person, create accounts to evade a suspension, or use false information on your profile.

3. What Perchworth is — and is not

Perchworth is an editorial and analytical tool. It helps you compare the cost of aging at home with residential senior living, organize quotes and rate sheets, talk with other caregivers, and find vendors who serve your area.

Perchworth is not a licensed financial advisor, certified financial planner, attorney, medical professional, social worker, geriatric care manager, or real-estate agent. Nothing on Perchworth — the calculator output, community posts, AI-generated text, vendor listings, or any other content — is professional financial, legal, medical, or care-planning advice. Use it as a starting point. Verify with appropriately licensed professionals before acting on it.

4. Calculator and AI-generated content

The calculator produces numbers based on the inputs you give it and assumptions we've coded in (rent escalation rates, inflation, frailty progression, and so on). Real-world outcomes diverge from any model. A facility may raise rates faster than expected. A home may appreciate slower than the regional average. Your care needs may rise or fall in ways no model can predict. Treat the output as a map, not the territory.

Some features use third-party artificial intelligence and large-language-model service providers (collectively, "AI Providers") to read documents you upload, estimate care intensities, or help draft text. AI output can be wrong, incomplete, or out of date. We label AI-generated content with "read and recheck" language for a reason — please actually do that. If a number, citation, or recommendation from an AI feature is important to your decision, verify it independently. The full third-party-providers clause is in section 20.

5. Documents you upload

You may upload rate sheets, tour quotes, brochures, or similar materials so the calculator and the AI can read them. Documents are private to you by default. You can share specific documents with other members through the sharing feature; you cannot make documents public.

Do not upload health details that identify or are linked to a person — doing so violates these Terms. That means protected health information (PHI): diagnoses, medications, medical record numbers, insurance identifiers. Perchworth is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA) and we do not solicit medical records. Redact those details before uploading. We may remove documents containing PHI and may suspend accounts that repeatedly upload it. You represent that you have the right to upload anything you share with Perchworth, and that doing so does not violate a contract or law — for example, a non-disclosure clause in a tour quote, or an embargo on rate cards. You indemnify Perchworth against claims arising from documents you uploaded without that right.

6. Community conduct

The community is the part of Perchworth where members post, comment, vote, and respond to each other. The rules:

  • Be civil. Disagreement is fine. Harassment, slurs, threats, doxxing, and personal attacks are not.
  • No spam, no scams, no commercial solicitation. If you have a business interest, apply for a vendor account. Do not pretend to be a regular member to drive leads.
  • No medical, legal, or financial advice presented as professional advice. You can share what worked for you; you cannot represent yourself as a licensed professional unless you actually are one and say so up front.
  • No identifying information about third parties. Don't post the full names, addresses, medical conditions, or financial details of people who have not consented to being discussed publicly. A short first name and general circumstances are usually fine; pasting a parent's discharge summary is not. Health details that identify a person are protected health information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA) and do not belong anywhere on Perchworth — see hhs.gov/hipaa/for-individuals for what counts.
  • Don't evade moderation. If a post or comment is removed, don't re-post it under another account. Appeal it instead by contacting us.

Perchworth's moderators may remove content, lock threads, or suspend accounts that violate these rules. Removed content is kept for a period (currently 30 days) for audit purposes, then deleted.

7. Your content and our license to display it

By posting content on Perchworth, you grant Perchworth a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute that content within the product as needed to run it. This license ends when you delete the content, except that we may keep a copy in backups and moderation logs for the retention periods described in our privacy page.

We may, in the future, license aggregated or anonymized data derived from member content — for example, published rate sheets contributed through document uploads, or aggregated scenario inputs that contain no identifying information — to research partners, academic institutions, journalists, or other third parties whose use is consistent with the editorial purpose of the site. We may also use such aggregated content to train models for product features.

If we materially expand how member content is used beyond delivering the product to you — including any transfer of identifying content, any commercial licensing of individual-level data, or any use of your content to train third-party AI models — we will email signed-in members at least 30 days before the change takes effect, and you will have the opportunity to delete your content (or your account) before that change applies to you. Individual member contact information is not part of any data feed today and is covered by the stronger privacy commitments on the privacy page.

8. Contacting vendors through Perchworth

The vendor directory at /vendors lets you send a message to a listed vendor through a contact form. When you submit a message, we send it via our email provider to the vendor's contact address with your account email set as the reply destination. Replies from the vendor go directly to your inbox — they do not pass through Perchworth. We keep a copy of the message you sent for up to 12 months for dispute resolution and abuse moderation; see the privacy page for the full retention policy.

Perchworth is not a party to any agreement, sale, or service relationship between you and a vendor. We curate the directory and review applications, but we do not warrant a vendor's services, prices, availability, or quality. If you contract with a vendor — for a home modification, an in-home aide, a medical alert system — that contract is between you and them. Disputes are between you and them. Refunds are between you and them.

9. Privacy

Our privacy page describes what we collect, what we don't, how long we keep it, and how to delete your account. It is part of these Member Terms by reference.

10. Free trial, read-only access, and paid subscription

Every Perchworth account begins with a 14-day free trial from the date of account creation. During the trial you have full access to the calculator, saved scenarios, document upload and review, vendor directory, and community. No payment is required to start.

After the trial ends, your account becomes read-only unless you subscribe:

  • Read-only (free, indefinitely). The cost calculator remains fully usable, and you keep read access to your saved scenarios, your documents, the community, the vendor directory, and the public facility pricing pages. Creating new posts or comments, uploading documents, and saving new scenarios are paused. Your data export and account deletion rights are unaffected.
  • Subscription — $3.99 per month or $39.99 per year (USD). An active subscription restores full write access: community posting, document upload, and saved scenarios.

Subscription terms:

  • You will be told the price clearly before any charge. We will not bill anyone without explicit consent.
  • Subscriptions auto-renew until cancelled. You can cancel from your dashboard at any time; cancellation takes effect at the end of the current period and your account transitions to the read-only state.
  • We do not offer pro-rated refunds for partial periods. If you cancel mid-period, you keep full access until the period ends.
  • Billing is processed by Stripe. Perchworth does not see or store your full card number — Stripe handles it directly.
  • We may change the subscription price with at least 30 days' notice by email. If you don't agree to the new price, you can cancel before it takes effect.

11. Termination and suspension

You can delete your account at any time from your account settings ("Danger zone") or by emailing hello@perchworth.com. Deletion is scheduled with a 14-day grace window — signing back in during that window cancels it — after which your data is removed as described on the privacy page.

We can suspend or terminate your account if you violate these Member Terms, engage in fraud, abuse the community, misuse the contact form, or use Perchworth in ways that harm other members. We'll tell you why when we can (sometimes legal process prevents us from doing so). Soft-deleted accounts and content are kept for the audit periods described in the privacy page, then permanently erased.

12. Intellectual property

Perchworth's site, code, copy, brand, calculator logic, prompts, and design are owned by the Operator and its successors. You may not copy, scrape, mirror, reverse-engineer, or build a competing product from Perchworth's content. You may quote a Perchworth page in a review, news article, or social-media post with attribution.

Automated access — scrapers, bots, headless browsers — is permitted only for indexing by major search engines and AI answer engines that respect robots.txt and llms.txt. Other bot access is prohibited.

13. Disclaimers

Perchworth is provided "as is" and "as available." We do not warrant that the site will be uninterrupted, error-free, or fit for any particular purpose. We do not warrant that the calculator output is accurate for your specific situation, that community advice is correct, or that any vendor will deliver what they promise.

To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law, Perchworth and the Operator are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the site — including lost profits, lost data, failure to save on senior-care costs, or harm caused by decisions you made using the calculator, the AI, the community, or a vendor.

Our total cumulative liability to you, for any cause and under any theory, will not exceed the greater of (a) the total fees you paid to Perchworth in the 12 months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

15. Indemnification

You agree to indemnify and hold harmless Perchworth, the Operator, and our successors and assigns from any claim, damage, or expense (including reasonable attorneys' fees) arising from (a) content you posted, (b) documents you uploaded, (c) your violation of these Member Terms, or (d) your interaction with a vendor.

16. Governing law and disputes

These Member Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved by good-faith discussion will be brought in the state or federal courts located in Bernalillo County, New Mexico, and you consent to personal jurisdiction there.

(If we ever add a binding-arbitration clause or a class-action waiver to these terms, we will email all members with at least 30 days' notice and an opportunity to opt out before it takes effect.)

17. Changes to these terms

We may update these Member Terms as the product evolves. For non-material changes (fixing typos, clarifying wording) we will update the "Last updated" date at the top. For material changes — anything affecting your rights, our liability, billing, or data use — we will email signed-in members at least 30 days before the new version takes effect, and ask you to re-acknowledge on your next sign-in.

18. Severability and entire agreement

If any part of these Member Terms is held unenforceable, the rest remains in effect. These Member Terms, together with the privacy page, are the entire agreement between you and Perchworth about your use of the site as a member, and supersede any prior version.

20. Third-Party AI Service Providers

The Service uses third-party artificial intelligence and large-language-model service providers (collectively, "AI Providers") to deliver features including document understanding and extraction, scenario configuration from free-form descriptions, and other AI-assisted capabilities we may add over time. The AI Providers we use may change from time to time without individual notice; the privacy page lists the providers currently in use and we will update that list as it changes. We require AI Providers, where contractually possible, to commit to:

  • Processing your data only as needed to deliver the feature you invoked.
  • Not using your inputs, prompts, or uploaded content to train their own models without explicit additional consent.
  • Deleting transient processing data within a commercially reasonable timeframe (the providers we use today commit to short retention windows for API content).
  • Maintaining industry-standard security controls (SOC 2, encryption in transit and at rest where applicable).

You acknowledge that:

  • AI outputs may be inaccurate, incomplete, biased, or out of date, and should be verified before they are relied upon for any decision with real-world consequences (placement, medical, financial, legal).
  • AI Providers may, in delivering the Service to you, briefly process the content you submit (uploads, prompts, scenario inputs) on their infrastructure.
  • Any outputs generated by AI Providers based on your inputs are not professional advice and do not establish a fiduciary, medical, legal, or other professional relationship.
  • Perchworth is not liable for AI Provider outages, latency, output errors, or changes in provider behavior beyond the limits stated elsewhere in these Member Terms.
  • If you have concerns about specific AI Providers being used to process your content, you can avoid invoking AI features (the calculator, community, scenario save, upload-and-store, and vendor directory functions all work without invoking an AI feature).

By signing up for a Perchworth member account, you confirm that you have read these Member Terms of Service, that you are at least 18 years old, and that you agree to be bound by them as of the "Last updated" date above.
